TERMS AND CONDITIONS
MISSION WINNOW SOCIAL MEDIA SWEEPSTAKE
(FOR ADULTS 21+)
1. INTRODUCTION
Please read these Terms and Conditions before entering this Promotion. By entering the prize draw (the "Promotion"), all participants will be deemed to have accepted these terms and conditions in full. All entry instructions form part of these terms and conditions. By participating in the Promotion, you represent that you satisfy all the eligibility requirements below.
The promoter is Philip Morris Products S.A. (the “Promoter”), a company incorporated in Switzerland, having its registered office located at Avenue de Rhodanie 50, 1007 Lausanne, Switzerland.
2. ELIGIBILITY
The Promotion is open to anyone who fulfils the following criteria:
· is resident of any country where it is lawful: (i) for the Participant to enter the Promotion, and (ii) for the Promoter to promote the Promotion and award a prize to the Participant;
· is at least 21 years of age on the date on which they enter the Promotion;
· has a valid Instagram account;
· is not an employee, officer or director of the Promoter and its affiliated companies, or of the advertising and promotion agencies of each, and their respective immediate families (including spouse, mother, father, sisters, brothers, sons and daughters, regardless of where they reside) and members of their households (whether related or not) (each a "Participant").
· Is no more than 60 years old at the time of the event (4th July 2022)
· Is no taller than 190cm
· Weighs no more than 90kgs
· Agrees to a medical check before the ride at the track (free of charge)
Important:
This Promotion is subject to all applicable laws and regulations and is void where prohibited.
This Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram.
3. HOW TO ENTER THE PROMOTION
To enter the Promotion each Participant must:
· follow the Promoter's Instagram account @MissionWinnow; and
· “Like” the post announcing the competition on 20/06/2022
· tag a friend (minimum 21 years old) in the comments below the @MissionWinnow post that announces this Promotion.
- No purchase is necessary to enter the Promotion.
- Each Participant may enter the Promotion multiple times.
4. PROMOTION PERIOD
Entry to the Promotion opens at 9:00 PM CEST on 20/06/2022 and closes at 00:00 a.m. CEST on 26/06/2022 (the "Promotion Period"). Entries submitted after the Promotion Period will not be eligible to win a prize. The Promoter’s (or its authorized representative’s) computers or server is the official time-keeping device for all matters related to the Promotion. All times referenced are in Central European Time.
5. PRIZES AND WINNERS
There is one (1) prize to be won, meaning one Winner only. The prize is a ride in the Ferrari 3-Seater at the Ferrari 3-Seater experience in Maranello, Italy as follows:
- A ride in the Ferrari 3-Seater car (one (1) ride for the Winner and one (1) ride for an adult friend aged 21+ of the Winners’s choice (bringing a friend is not obligatory, the winner can claim the prize just for themselves) - IF THEY WILL WANT TO PARTICIPATE IN THE RIDE THEY MUST MEET THE SAME REQUIREMENTS AS PARTICIPANTS IN TERMS OF MAX AGE/WEIGHT/HEIGHT);
- Return flights to and from Bologna or Milano including cabin bag cost for the Winner and their adult friend (travel will be on the same flight). The departure airport will be the Winner’s nearest international airport that operates direct flights to Bologna or Milano.
- Two (2) nights' accommodation, including breakfast, in a 5 star hotel in Modena chosen by the Promoter, based on two adults sharing (one shared room for the Winner and their adult friend).
- transportation in Modena and Maranello (airport to the hotel and back; hotel to the circuit and back) for the Winner and their adult friend;
- two (2) standard meals per person provided per day (winning Participant and their adult friend).
Please note: The Winner will be solely responsible for ensuring that the two persons travelling (the Winner and their adult friend) have all necessary travel documentation and entry requirements (valid passport/visa/vaccination or similar certificates or passports etc.) required to travel to Italy and back to their home country. The Winner and their adult friend may need a visa for this destination, which they should arrange with the Embassy at their own expense. The Winner will be solely responsible for arranging and covering any travel insurance, as well as for arranging any other requirements necessary for travel to the destination and back to their home country and covering the relevant fees. All taxes are solely the Winner’s responsibility.
- The Promoter will choose one Winner at random by computer on 27/06/2022 by 4pm.
- The Promoter will notify the Winner by direct message on Instagram on 27/06/2022 with details of how to claim their prize. The winner(s) must respond to the direct message from the Promoter on Instagram confirming their full name, age and email address and/or mobile phone number within 24 hours of being contacted.
6. CONDITIONS
- In the event that the Promoter is unable to contact a winner within 24 hours of being contacted, or if the Winner is not eligible, the Promoter reserves the right to award to prize to an alternative winner selected at random by computer from all remaining eligible entries.
- The prize is non-refundable, non-transferable and non-exchangeable and cannot be resold. The prize is as stated, and no cash or other alternatives will be offered. The Promoter reserves the right to substitute an alternative prize of equal or greater value.
- No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices, or that do not fully comply with these terms and conditions are permitted and no bulk entries.
- The Promoter may request that the Winner takes part in reasonable publicity in respect of the Promotion. If you are the Winner, the Promoter may use your name and country of residence to announce the winners of the Promotion on @MissionWinnow or your Instagram ID. Please contact us if you do not want us to make your details available in this manner (if so, please note that the Promoter may nonetheless be obliged to provide details of the Winner to the relevant regulators).
- All costs and expenses not included within the prize are the responsibility of the Winner.
- The Promoter reserves the right at any time, in its absolute discretion, to:
o verify the eligibility of any Participant (including their age and place of residence);
o disqualify any Participant found to be abusing or tampering with the operation of the Promotion or entering using fraudulent means, or who the Promoter believes to have acted in breach of these terms and conditions including in cases of inappropriate or offensive entries;
o disqualify Participants who do not give correct contact details or those who make an entry on someone else's behalf; and
o verify the identity of each Winner (and their adult friend) before awarding a prize.
8. LIABILITY
- If the Promoter fails to comply with these terms and conditions, the Promoter is responsible for loss or damage you suffer that is a foreseeable result of the Promoter's breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of the Promoter's breach or if they were contemplated by you and the Promoter at the time that you entered the Promotion.
- Except as otherwise required by applicable law, the Promoter accepts no responsibility or liability for any entry or claim which for technical or other reasons is unsuccessful, incomplete, lost, late, damaged, corrupted or misdirected.
9. DATA PROTECTION & PRIVACY NOTICE
- All personal data submitted in connection with the Promotion will be processed by the Promoter for the purposes of administering and managing the Promotion and prizes (where applicable) and verifying the eligibility of each Participant. The Promoter is committed to protecting the privacy of all Participants. Data that is collected from or about Participants will be used in accordance with the Promoter's Privacy Policy (which also includes information about the data rights of Participants), a copy of which can be found at https://www.missionwinnow.com/en/legal-pages/privacy-notice/.
- OPT OUT: If you do not wish to receive future Promotion communications from the Promoter please block or unfollow the accounts.
10. GENERAL:
- Any decision of the Promoter in respect of the Promotion is final.
- The Promoter reserves the right to extend, withdraw, alter or suspend the Promotion or these terms and conditions at any time without liability and without prior notice if circumstances beyond its control make this unavoidable.
- By participating in the Promotion, Participants: (a) agree to release Promoter and Instagram from all liability, loss or damage arising out of participation in the Promotion or in connection with the awarding, receipt, possession, use and/or misuse of any prize; and (b) agree and acknowledge that neither Promoter nor Instagram makes any warranty, representation, or guarantee, expressed or implied, in fact or in law, relative to any prize, and disclaim all liability for the provision, quality or nature of any third-party products or services provided to Prize winners.
- The Promotion and these terms and conditions, and any dispute or claim arising out of or in connection with them shall be governed by, and construed in accordance with, Swiss law and any disputes will be subject to the exclusive jurisdiction of the courts of Switzerland.
